1. The Promoter

    The promoter is: Inverness Glass Company Limited (trading as Cairngorm Group) of Cairngorm Windows, Longman Drive, Inverness, IV1 1SU.

  2. The competition

    1. The title of the competition is the “Cairngorm Group 70th Anniversary Prize Draw.
    2. Entry to the Competition is free. No purchase is necessary as a condition of entering the Competition. The winning entries shall be drawn at random by the Promoter.
  3. How to enter

    1. Each day in June 2023 the Promoter will draw a winner from all of the entries received that day between 9am until 5pm on the day of each prize draw.
    2. All competition entries received after 5pm on the relevant day are automatically disqualified.
    3. To enter the competition each entrant must enter the competition online by completing the online entry form available on the Promoter’s website and submitting online at cairngormgroup.co.uk/70-anniversary-giveaway/.
    4. No purchase is necessary and there is no charge to register for use of the website.
    5. By submitting a competition entry, you are agreeing to be bound by these terms and conditions.
    6. Entrants may contact the Promoter at the Promoter’s website to make any enquiries regarding the completion of the competition entry form.
  4. Eligibility

    1. The competition is only open to all residents in the Highland or Moray local Authority areas aged 18 years or over, except:
      1. employees of the Promoter or its holding or subsidiary companies;
      2. employees of agents of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or
      3. members of the immediate families or households of (a) and (b) above;
      4. residents out with the Highland or Moray local authority mainland (Skye being deemed to be a part of the mainland for purposes of the competition).
    2. In entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition.
    3. The Promoter will not accept competition entries that are:
      1. automatically generated by computer;
      2. completed by third parties or in bulk; or
      3. incomplete.
    4. There is a limit of one entry to the competition per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
    5. 4.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.
  5. The prizes

    1. Please refer to the Promoter’s Website cairngormgroup.co.uk for details of the prizes available to be won. There will be 29 daily prizes in respect of which the draw will be made on each of the 1st June to 29th June, inclusive (“Daily Prizes”) and one Grand Prize drawn on 30th June 2023 (the “Grand Prize”). Entrants may win the Grand Prize in addition to one Daily Prize. Entrants may win only one Daily Prize.
    2. There is no cash alternative for any Daily Prize or the Grand Prize. Daily Prizes are not and the Grand Prize is not transferable by the winner to any third party.
    3. In circumstances where a prize involves installation of solar panels or equipment, this will only be undertaken by the Promoter:
      1. at the private residence of the winner and on the roof of the winner’s property (no free standing or ground mounted alternative will be offered);
      2. provided the winner can demonstrate that he/she owns the property at which the solar panels are to be installed;
      3. with the written consent of all joint owners of the winner’s property but provided no local or government authority or other incorporated entity, club, partnership or commercial concern has any ownership right or partial ownership right in the property at which the solar panels are to be installed;
      4. with the consent of any party whose consent is reasonably required before work to instal solar panels is commenced (which may include a mortgage lender or security holder in some circumstances) declaring that it will be the responsibility of the winner to obtain any such consents and deliver a copy of such consents to the Promoter before work may commence at/on the winner’s property;
      5. provided all necessary planning consents, building warrants and (where appropriate) Conservation Area consents or Listed Building Consents can be obtained by and at the cost of the winner within a period of 6 months from the date of the announcement of the winner of the prize.
    4. Where consents are required but are not obtained by the winner the Promoter reserves the right to delay commencement of the installation of the solar panels at/on the winner’s property until all necessary consents are received. The Promoter is not responsible for the winner’s failure to obtain any such necessary consents, and in circumstances where the Promoter commences installation prior to the winner receiving any such consents the winner indemnifies the Promotor for all costs losses or claims which the Promoter incurs as a result of such failure and the winner agrees that the Promoter shall have no liability to the winner or to any third party for any costs, losses or claims incurred by the winner (including without prejudice to the generality any costs of removing the solar panels or any other equipment installed or fixed to the winner’s property as part of the process of installing the solar panels).
    5. In the event that planning consent, building warrant or conservation area consents or Listed Building consents.
    6. The prizes are supplied by the Promoter. The Promoter reserves the right to replace any prize with an alternative prize of equal or higher value if circumstances beyond the Promoter's control makes it impossible or impracticable to supply any advertised prize or where it becomes necessary for the Promoter to do so. In circumstances where the Promoter is unable to carry out work to the winner’s Property in order to supply the prize to the winner the Supplier is not required to offer an alternative prize.
    7. The prize is not negotiable or transferable.
    8. The Promoter will randomly draw one winner of each prize on the day after the closing date for entries for each prize.
    9. In order to claim the prize you must be contactable on the contact details supplied on the entry form within [7 days] of winning the prize. The Promoter will make all reasonable efforts to contact each winner as soon as practicable after each prize is won. If the winner cannot be contacted within [7 days] the Promoter may redraw the prize and supply the prize to a new winner.
  6. Winners

    1. The decision of the Promoter is final and no correspondence or discussion regarding the decision of the Promoter will be entered into.
    2. The Promoter will contact the winner personally as soon as practicable after the Announcement Date, using the telephone number or email address provided with the competition entry. The Promoter will not amend any contact information once the competition entry form has been submitted.
    3. The Promoter will either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and home city/town or county of major prize winners and, if applicable, their winning entries on their website and in any media publication or radio show that the Promoter may select at its discretion (Announcement Date).
    4. If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter at the following email address: info@cairngormgroup.co.uk / Contact Form. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
  7. Claiming the prize

    1. Please allow a reasonable period for delivery of each prize. The period which will be reasonable in each case will depend on the nature of the prize won. In most cases the Promoter estimates that the prize will be delivered or made available to the winner within 14 days of the announcement of the winner of the price. Delivery of the Grand Prize, or any other prize which involves work being carried out at the prize winner’s property may be subject to a longer a longer delivery period in order that the Promoter can be satisfied that all necessary consents and verifications as to the suitability of the property have been received or satisfied. The Promoter will use its reasonable endeavours to supply, fit and install solar panels within a reasonable time after all such considerations have been satisfied.
    2. The prize may not be claimed by a third party on your behalf.
    3. The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted, or is not available, or has not claimed their prize within seven of days of the Announcement Date, the Promoter reserves the right to redraw the prize and offer the prize to the next eligible entrant selected entries that were received before the Closing Date.
    4. The Promoter does not accept any responsibility if you are not able to take up the prize.
  8. Limitation of liability

    Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

  9. Data protection and publicity

    1. The Promoter will (subject to condition 6.3 and condition 6.4, with regard to the announcement of winners) only process your personal information as set out in the Promoter’s Data Protection Policy which can be found on the Promoter’s website, here: Privacy Policy
  10. General

    1. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
    2. The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
    3. These terms and conditions are governed by the law of Scotland. Any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these terms and conditions or their subject matter shall be governed by and construed in accordance with the law of Scotland.
    4. By entering the competition, entrants irrevocably agree that the Scottish Courts shall have exclusive jurisdiction to settle any dispute or claim including non-contractual disputes or claims) arising out of or in connection with the competition or its prizes.
